TITLE ONE – PRESENTATION

The SARL Hôtel La Cachette, with a capital of 900 000 euros, hereafter ‘the company’, whose head office is located at 33 Rue Brun Larochette, 26220 Dieulefit, SIRET N° : 82292601000023 – VAT N° : FR02822926010, operates the Hotel & Spa “HÔTEL LA CACHETTE” at the same address. It has taken out a multi-risk professional insurance policy N° 148194982 with the company MMA Entreprises, 8 Rue Malautiere 26220 DIEULEFIT.

The opening days and hours of the HÔTEL LA CACHETTE vary according to the season. For technical reasons beyond the company’s control, HÔTEL LA CACHETTE may not be reachable at any time by any of the means listed above.
TITLE TWO – HOTEL INDUSTRY
HOTEL LA CACHETTE offers several categories of rooms on the same site.
In the event of a reservation for several nights, HÔTEL LA CACHETTE will, as far as possible, allocate the CLIENT the same room for the entire stay reserved. If this proves impossible and one or more relocations are necessary during the CUSTOMER’s stay, the CUSTOMER will not be entitled to any financial compensation whatsoever as long as the rooms actually allocated during the stay belong to the same category reserved.
The rooms are made available to customers from 4:00 pm on the day of arrival until 11:00 am on the day of departure. If the room is ready before 4:00 p.m., the CLIENT may take possession of it at the discretion of HÔTEL LA CACHETTE. However, if, at the time of reservation, the CLIENT wishes to obtain a guarantee that he/she will be able to take possession of the room before 4:00 p.m., HÔTEL LA CACHETTE may be required to charge a flat fee. Similarly, for late departures (after noon on the day of departure), even if they have been expressly validated by email or mail, HÔTEL LA CACHETTE may be required to charge the amount of an additional night.
HÔTEL LA CACHETTE may decide to upgrade the CUSTOMER to a higher category room without increasing the rate for the CUSTOMER. The CLIENT may not object to such an upgrade.
All hotel rooms and common areas are non-smoking areas. It is possible to smoke in the gardens and on the terraces.
Within the same category of rooms, HÔTEL LA CACHETTE allocates the different rooms available to its clients according to its reservation schedule. Under no circumstances may HÔTEL LA CACHETTE be required to assign a specific room, or even a specific location or equipment to the CLIENT within the category of rooms he/she has reserved.
Pets are allowed at HÔTEL LA CACHETTE. A supplement of €20.00 per night and per pet will be charged.
Outside the rooms, pets must be kept on a leash, under the responsibility of their master. Pets are not allowed in the SPA. The common rooms are accessible to animals kept on a leash, provided that the customers present are not inconvenienced. HÔTEL LA CACHETTE reserves the right to cancel the reservation of a CLIENT arriving at the establishment with a pet whose acceptance has not been formally validated by email or letter prior to the reservation. In such a case, the establishment reserves the right to charge the full cost of the stay thus cancelled by the company.
All rooms in the hotel are double rooms that can be booked by one or two people.
Proper dress and behavior are required throughout the hotel. Shorts and sandals should not be worn in the restaurant at night. The company may cancel the CLIENT’s reservation if these conditions are not respected. In such a case, the entire amount of the reserved stay and any consumption will be charged. In the event that the CUSTOMER is the cause of night-time disturbances in the establishment, the company will be entitled to charge the CUSTOMER the cost of the discounts granted by HÔTEL LA CACHETTE to other CUSTOMERS in compensation for the inconvenience caused by the CUSTOMER.
By accepting a reservation, CUSTOMER agrees to behave in a responsible manner during his stay. HÔTEL LA CACHETTE will be entitled to charge the CLIENT for any damage, loss or disappearance of equipment, whether voluntary or not, that is noticed during the stay or within 4 hours of departure.
After arriving at the hotel and using the room reserved, particularly with regard to bedding and bathroom facilities, CUSTOMER may not request to be relocated to another room, unless LA CACHETTE can offer to do so in light of existing availability. In such a case of dislocation after the use of the room initially reserved and used, the company will be able to invoice the 2 rooms used by the customer at the rate of these rooms.
Food and beverage service during stays at the hotel is provided exclusively by HÔTEL LA CACHETTE and BISTROT NOISETTE. The consumption of food or beverages purchased by clients outside of the establishment is not authorized, unless expressly validated by the company by email or mail prior to the date of arrival.
The establishment is strictly non-smoking, including in the rooms. If, upon the CLIENT’s departure, HÔTEL LA CACHETTE’s room service staff notes the presence of tobacco odors in the room occupied by the CLIENT or the presence of ashes or cigarette butts in the garbage cans in the rooms, HÔTEL LA CACHETTE may automatically charge deodorization fees at a flat rate of €150.00, including tax. If the smell of tobacco is so persistent that HÔTEL LA CACHETTE must close the room for one or more nights after the CUSTOMER’s departure, an indemnity corresponding to the rate for the nights of closure increased by 50% will be invoiced to the customer and debited from the credit card used by the CUSTOMER at the time of reservation. By making a reservation at HÔTEL LA CACHETTE, the CLIENT accepts this principle and expressly authorizes the company to deduct these fees from his/her credit card.
II. RESERVATION CONDITIONS
Reservations for rooms at the hotel must be confirmed by an email sent to the CLIENT by HOTEL LA CACHETTE. Without such written confirmation, the CUSTOMER will not be able to take advantage of a reservation.
Sending reservation proposals or options to CUSTOMER does not imply any obligation without written confirmation of the reservation by LA CACHETTE.
The communication by the CUSTOMER of the data of a guarantee bank card does not allow the CUSTOMER to take advantage of a reservation. The same applies to verbal exchanges with the staff of the establishment. Only a written confirmation sent by email to the CLIENT by HOTEL LA CACHETTE attests to the existence of a reservation. Under no circumstances may the absence of a response or a delay in responding to a reservation request by HÔTEL LA CACHETTE be interpreted as a confirmation of a reservation.
Room reservation proposals and options have a limited validity period and are subject to availability and rates in effect on the day of confirmation of the reservation by the Company.
A room reservation will only become firm and definitive after communication of:
1.- the details of a valid credit card including :
• the credit card number itself (Visa, Eurocard, MasterCard, Carte Bleue or American Express)
• the corresponding validity date
• and the cryptogram
2.- A valid telephone number (mobile if available, fixed otherwise).
The fact of communicating a credit card number implies the full and unreserved acceptance of the present General Terms and Conditions of Sale. The company reserves the right to debit the credit card for the amount of the reserved stay before the CLIENT’s scheduled arrival date.
In the absence of a credit card, the payment of a deposit by bank transfer is possible up to 14 days before the planned arrival date. In this case, the amount to be paid is equivalent to 100% of the reserved stay. The deposit paid is considered as acquired and non-refundable 72 hours before the date of arrival at 16:00. Like the credit card number, the payment of a deposit implies full and unconditional acceptance of the present General Terms of Sale.
In the particular case of gift vouchers issued by L’HÔTEL LA CACHETTE or by the various partners or organizations that have concluded a specific agreement with L’HÔTEL LA CACHETTE, a valid credit card number, with a validity date and cryptogram, is also imperative. In all cases, the present General Terms and Conditions of Sale prevail over any other conditions set forth by the partners of HÔTEL LA CACHETTE.
The CUSTOMER who wishes to pay all or part of the cost of his or her stay at HÔTEL LA CACHETTE in checks/vouchers issued by partners or organizations that have entered into a specific agreement with HÔTEL LA CACHETTE must inform the company at least 14 days before the planned arrival date. Under no circumstances will the company be obliged to accept this means of payment unless the company has explicitly approved the clause in the specific agreement with the partner concerned. Unless previously approved by letter or e-mail, the company may also limit the number of checks/vouchers that the CLIENT wishes to use for the payment of his/her reservation.
The company reserves the right to check the CLIENT’s credit card details, to preserve the amount of the reserved stay at any time and to debit the CLIENT’s credit card as soon as the cancellation period without charges (see point III) has expired. If the CUSTOMER’s credit card details are incorrect or if the amount of the stay could not be preserved on this credit card, the company may cancel the CUSTOMER’s reservation by right.
III. CANCELLATION POLICY
A. FOR THE CLIENT
1 – Reservation of one to two rooms, maximum :
a) For a stay less than or equal to 3 nights: the cancellation or modification must be made more than 72 hours before the scheduled arrival (assuming that the arrival is at 4 pm, on the day of arrival).
In case of cancellation or modification more than 72 hours before arrival, no fee is due by the CLIENT. In the event of a deposit being paid, the deposit may be retained by HÔTEL LA CACHETTE and deducted from the CLIENT’s next stay within the limit of one year from the date of cancellation.
In the event of cancellation or modification within 72 hours, HÔTEL LA CACHETTE will charge the full amount of the reserved stay (number of nights x number of rooms x total price of the reserved rooms) by debiting the card used for the confirmation, or any other available means of payment.
b) For a stay of more than 3 nights: the cancellation or modification must be made more than 14 full days before the scheduled arrival.
In case of cancellation or modification more than 14 days before arrival, no fee is due by the CLIENT. In the event of a deposit being paid, the deposit may be retained by HÔTEL LA CACHETTE and deducted from the CLIENT’s next stay up to a maximum of one year from the date of cancellation.
In the event of cancellation or modification less than 14 days before the date of booking, HÔTEL LA CACHETTE will charge the full amount of the stay booked (number of nights x number of rooms x total price of the rooms booked) by debiting the card used for the confirmation, or any other available means of payment.
2 – Reservation of more than two rooms:
The cancellation or modification must be made more than 30 days before the scheduled arrival. In case of cancellation or modification more than 30 days before arrival, no fee is due by the CLIENT. In the event of a deposit being paid, the deposit may be retained by HÔTEL LA CACHETTE and deducted from the CLIENT’s next stay up to a maximum of one year from the date of cancellation.
In the event of a cancellation or modification less than 30 days prior to the date of booking, HÔTEL LA CACHETTE will bill the CLIENT for the entire stay (number of nights x number of rooms x total price of the rooms booked) by debiting the card used to confirm the booking, or by any other available means of payment.
3 – Special cases :
The cancellation or modification conditions detailed above are valid in all cases, even if the period between the date of reservation and the date of stay is shorter than the applicable cancellation period. In case of cancellation or modification during the stay, the totality of the reserved stay is due.date de réservation et la date de séjour est inférieure au délai d’annulation applicable. En cas d’annulation ou modification en cours de séjour, la totalité des frais du séjour réservé est due.
B. FOR HOTEL LA CACHETTE
HOTEL LA CACHETTE reserves the right to cancel a reservation under the same conditions as those available to the CLIENT (see above). In this case, the cancellation only leads to the reimbursement of any deposit paid. An alternative solution may be proposed at the discretion of HÔTEL LA CACHETTE.
HÔTEL LA CACHETTE is in arrears with payments for previous stays. In this case, the cancellation will result in the payment of twice the deposit paid by the CLIENT by HÔTEL LA CACHETTE.
HÔTEL LA CACHETTE reserves the right to cancel the reservation of a CUSTOMER who has reserved more than 5 rooms on an online reservation site other than that of the company www.hotellacachette.fr. In this case, the cancellation will result in the payment to the CLIENT by HOTEL LA CACHETTE of twice the deposit paid by the CLIENT.
IV. IMPOSSIBILITY FOR THE HOTEL LA CACHETTE TO HONOR THE RESERVATION
In the event that the hotel is unable to accommodate the CLIENT in the reserved room within 72 hours (force majeure, technical incident), HÔTEL LA CACHETTE undertakes :
1.- in the event that the hotel is not full, to offer another room within the establishment itself. In this case :
– if the room is of equivalent category, the CLIENT pays the normal room rate.
– if the room is of a higher category, HÔTEL LA CACHETTE will only charge the price of the room initially booked.
– if the room is of a lower category, HÔTEL LA CACHETTE can only charge the price of the room actually occupied. 2) If the hotel is full, to propose a room in another establishment within a radius of 75km around Dieulefit.
If the rate is higher than the one of the room initially booked, HÔTEL LA CACHETTE will pay the price difference. The refusal by the CUSTOMER of the alternative solution proposed by the company induces the refunding of the possible deposits paid doubled, in accordance with the article L.131-1.I of the Code of the Consumption.
In the event that legislative or regulatory measures are taken by the French State or the Auvergne-Rhône-Alpes Region to combat the spread of a virus or epidemic and that these measures do not allow HÔTEL LA CACHETTE to offer its customers all of its services both inside and outside of the buildings during their stay HÔTEL LA CACHETTE may cancel, without compensation, the reservation of customers who have booked a stay or another service during the period affected, in whole or in part, by these measures. In such a case, HÔTEL LA CACHETTE will inform its customers of the cancellation without delay by telephone or by e-mail and will reimburse the CLIENT up to twice the amount of the deposit paid.
V. LOST ITEMS
It may happen that the CUSTOMER forgets certain personal items at HÔTEL LA CACHETTE after his/her departure. The company will be able to keep these lost objects in a closed room for a maximum of 7 days after the CLIENT’s departure. The company declines all responsibility for any damage to or theft of objects during or after this period. These objects will be kept at the CLIENT’s disposal for a period of 7 days after his departure. On request of the CLIENT, the company will be able, according to its availability, to send these objects to the CLIENT. In order to cover the company’s shipping and handling costs, the CUSTOMER will provide HÔTEL LA CACHETTE with the complete details of a bank card and his/her prior agreement to the debiting of the amount of the costs on said bank card. A flat fee of €40.00 including VAT will be charged and added to the amount of the postal charges to cover the cost of labor, transportation and waiting at the nearest post office. Since the staff of HÔTEL LA CACHETTE is exclusively occupied with the service of the guests in the establishment and does not normally have the time necessary to process these mailings, the company cannot be held to any delay for these returns of lost objects.
In the event of loss of items in the hotel elevator, any costs incurred for the intervention of a technician will be charged exclusively to the CLIENT.
In the event that the CLIENT has not returned his room key and/or his switch badge upon leaving the hotel, a fixed fee of €45.00 including tax will be charged to the CLIENT. This amount will be charged to the credit card used by the CLIENT when making the reservation. The CLIENT’s reservation automatically implies authorization to debit this fee.
TITLE THREE – SPA
HOTEL LA CACHETTE provides CLIENTS staying at the hotel with :
- A swimming pool
- A Sauna
- A Jacuzzi
- A Hammam
- A gym
The use of these places is under the exclusive responsibility of the CLIENT.
Clients who have reserved a table at the Bistrot de l’HÔTEL LA CACHETTE, but who are not staying at the hotel, do not have access to the establishment’s SPA.
Correct dress and behavior are required throughout the establishment, including the SPA.
TITLE FOUR – GIFT VOUCHERS, SHOP, PARKING and WELLNESS CENTER
A. GIFT CERTIFICATES ISSUED BY US
LA CACHETTE HOTEL produces and issues gift certificates. They are valid for one year from the date of issue. After that date, they may no longer be used and the corresponding amounts are definitively acquired by HÔTEL LA CACHETTE. Vouchers and vouchers are valid on the day of full payment of their price.
These vouchers and checks are not exchangeable, refundable (in whole or in part), transferable or assignable. Change cannot be given in any case (for example, if part of the service is not consumed by the beneficiary).
However, at the request of the beneficiary, and upon express written acceptance by HÔTEL LA CACHETTE, the nature of the service may be modified, within the double limit of the validity date and the value (amount in Euros) of the gift certificate or gift voucher offered. In the event of a modification, with a final value greater than the initial value of the gift certificate, the beneficiary must pay the corresponding supplement.
HÔTEL LA CACHETTE may offer items as an accessory to its hotel and restaurant business. The conclusion of the sale is subject to the availability of the items on the day of the purchase. If necessary, any amount paid, without the corresponding availability, will be completely refunded to the CUSTOMER.
The HOTEL LA CACHETTE offers a parking lot for its customers. It is strictly reserved for the hotel’s resident guests.
Hotel guests are authorized to park one vehicle per room for the duration of their stay. Any vehicle that remains parked in the parking lots of HÔTEL LA CACHETTE or elsewhere on the property of the establishment may be blocked by the means available to the Company. HÔTEL LA CACHETTE will be entitled to charge a parking fee of €20.00 per hour of unauthorized parking.
The Company expressly declines all responsibility for any damage caused to the vehicles, their contents or for any injuries caused to persons in this parking lot which would result from a case of force majeure, nor for losses which result from the nature or vice of the thing.
By using these parking lots, guests and other visitors to HÔTEL LA CACHETTE expressly release the company from any obligation to display these risks and limitations of liability.
The use of the parking lots by customers may be invoiced at a rate of €5.00 per vehicle and per night. HÔTEL LA CACHETTE offers free use of these parking lots for any direct reservation by telephone, e-mail or via its own website.
HÔTEL LA CACHETTE provides its guests who have booked a room at the hotel with 2 charging stations for electric vehicles. The use of the latter will be invoiced to the client at a rate of €20.00 per vehicle per night, including tax, in order to contribute to the cost of this investment (more than €3000.00 excluding tax).
The HOTEL LA CACHETTE offers a park. Its access is authorized only to the customers of the establishment. Access to the properties adjacent to this area is forbidden
Persons taking advantage of the area, legally or otherwise, do so at their own risk and peril. The company expressly declines all responsibility for any accident that may occur on the property and of which people and their property may be victims. In particular, HÔTEL LA CACHETTE hereby draws the attention of its guests and other visitors to the risks of falling trees and the property.
By entering the property, guests and other visitors to HÔTEL LA CACHETTE expressly relieve the company of any obligation to display these risks.
E. WELLNESS CENTER
HOTEL LA CACHETTE offers a Wellness Center on its site. It offers treatments (massages) as well as several facilities depending on the season: sauna, hammam, jacuzzi, swimming pool and fitness room.
Proper dress and behavior are required throughout the establishment. The company may cancel the CLIENT’s reservation if these conditions are not respected. The full amount of the reserved treatments and access will be charged in such a case.
By accepting the reservation, the CLIENT agrees to behave in a responsible manner during the reservation. HÔTEL LA CACHETTE will be entitled to invoice the CLIENT for any damage or disappearance of equipment noted at the time of departure or within 4 hours thereafter.
II. RESERVATION CONDITIONS
Reserving by telephone does not necessarily imply written confirmation from HÔTEL LA CACHETTE, unless CUSTOMER expressly requests it, provided that CUSTOMER has clearly communicated his or her exact contact details and that the time given for the reply is sufficient for it to reach CUSTOMER. Before confirming the reservation, HÔTEL LA CACHETTE may require the CUSTOMER to prepay the reservation or to guarantee it by providing full credit card details.
In any case, the absence of a response from HÔTEL LA CACHETTE to a request cannot be interpreted as a confirmation of a reservation.
Reservations for treatments and access to the Wellness Center’s facilities are kept by HÔTEL LA CACHETTE for ten minutes only, starting from the time agreed upon at the time of reservation. After that time, L’HÔTEL LA CACHETTE is free to use the reserved treatment rooms and access to the facilities. In case of delay, it is imperative that the CLIENT informs LA CACHETTE. In case of delay, even after the company has been informed, the duration of the treatment or access to the facilities will be reduced to the extent of the CLIENT’s delay in arrival, without any reduction in the cost of the reserved treatments and access. In the event that the CLIENT does not honor his reservation (no show), the entirety of the treatments and access reserved will be invoiced.
III. CANCELLATION POLICY
A. FOR THE CLIENT
For any treatment or access to the facilities reserved by THE CUSTOMER, the cancellation or modification must occur more than 24 hours prior to the reservation time. In case of cancellation or modification more than 24 hours before arrival, no fee is due by the CLIENT. In the event of a deposit being paid, the deposit may be retained by HOTEL LA CACHETTE and deducted from the CLIENT’s next reservation within the limit of one year from the date of cancellation.
In the event of cancellation or modification within 24 hours or ‘no show’, HÔTEL LA CACHETTE is entitled to charge the full amount of the treatments and access reserved.
The cancellation or modification conditions detailed above are valid in all cases, even if the period between the date and time the reservation was made and the date and time of the service is shorter than the applicable cancellation period.
B. FOR HOTEL LA CACHETTE
HOTEL LA CACHETTE reserves the right to cancel or modify a reservation under the same conditions as those available to the CLIENT (see above). In this case, the cancellation or the modification induces the refunding of the possible deposits paid, with the amount calculated as defined by the Article L.131-1.I of the Code of the Consumption. An alternative solution may be proposed at the discretion of HÔTEL LA CACHETTE.
HÔTEL LA CACHETTE reserves the right to cancel or modify the reservation of a CUSTOMER with whom a dispute exists. In this case, the cancellation will result in the reimbursement of any deposit paid. The refusal by the CUSTOMER of the alternative solution proposed by the HOTEL LA CACHETTE induces the refunding of the possible deposits paid, with the amount calculated as defined by the Article L.131- 1.I of the Code of the Consumption.
TITLE FIVE – FEES & REGULATIONS
The indicative rates published on the HÔTEL LA CACHETTE website www.hotellacachette.fr and on the establishment’s commercial documentation are indicated inclusive of all taxes, except for the tourist tax which is never included (unless explicitly mentioned), and excluding any transport costs.
Only the rates confirmed by e-mail to the CLIENT at the time of reservation are binding on the parties. These rates may differ from the rates offered by reseller sites (booking.com, expedia, etc.) or online rate comparators.
Rates are subject to significant variation during the year, it being understood that the rooms, services or products reserved are invoiced at the price in effect at the time the reservation is made.
HÔTEL LA CACHETTE may run last-minute promotions on its room rates to encourage reservations on specific dates. Under no circumstances may the CLIENT who has booked on a date prior to these promotions demand the application of a rate equivalent to these promotions, as they generally apply to rooms different from the one he/she has booked, even within the same category of rooms.
The price of offers and reservations made during the year for the following year are subject to adjustment in the event of changes in the VAT and tourist tax rates applicable during the year of stay.
The rates offered by L’HÔTEL LA CACHETTE to agencies or intermediaries in the context of group offers (seminars, rallies, weddings, etc.) may not be increased by these agencies or intermediaries under any circumstances. If these agencies or intermediaries offer their client(s) a higher amount than the offer made by LA CACHETTE, the company will invoice these agencies or intermediaries for the difference between the amount invoiced to the client(s) and the amount of the offer made by LA CACHETTE. If the intermediary cannot guarantee, with documentary evidence, that he/she has not charged his/her client more than the offer made by LA CACHETTE HOTEL, he/she will not be entitled to any agency or intermediary commission.
II. TERMS OF PAYMENT
For all stays and services, the total price of these and the expenses involved, called “extras” (such as meals and drinks, telephone, the boutique, the Wellness Center, room service, purchases in the boutique, etc.) must be paid in full at the time of departure, unless otherwise agreed in writing by e-mail or postal mail by HÔTEL LA CACHETTE before the start of the stay or service.
The payment of the purchases on the spot is made exclusively in Euros and can be made by the following methods:
• cash within the limit of 1000€ per invoice
• Visa, Eurocard, MasterCard, Carte Bleue
Any sum not paid at its due date (date of the invoice) will produce by right, and without prior notice, penalties of delay at a rate of 10% per year, to which will be added the expenses of 45,00€ including all taxes by reminder of payment by e-mail or mail. In case of late payment, HÔTEL LA CACHETTE will be able to suspend all orders in progress, without prejudice to any other course of action.
TITLE SIX – INTERNET ACCESS
HÔTEL LA CACHETTE provides its CLIENTS with Internet access, mainly by wifi, for which specific rules of use apply. Access is authorized at the discretion of HÔTEL LA CACHETTE. This service is offered free of charge to the CLIENT. It may happen, for various technical reasons, that this service is unavailable during all or part of the CLIENT’s stay. In such a case, the company will do its utmost to restore the functioning of this service.
LAST TITLE – LEGAL FRAMEWORK
It is up to each CLIENT to find out, before booking, about any national or local events such as carnivals, religious holidays, national holidays that could affect the smooth running of the stay. No claim for this fact can be addressed to HÔTEL LA CACHETTE. Any claim for non-performance or poor performance of the sales contract must be reported on the spot by the CLIENT to HÔTEL LA CACHETTE, stating the grievances within two hours of arrival, and if necessary, immediately after the finding.
1 – Contact:
It may happen that HÔTEL LA CACHETTE cannot be reached momentarily by one or more of the means listed herein, for technical reasons beyond its control. HÔTEL LA CACHETTE may in no way be held responsible for this situation, nor for any direct or indirect damage, regardless of the causes, origins, nature or consequences, caused by this inability to contact HÔTEL LA CACHETTE.
2 – Non-performance & Force Majeure:
HÔTEL LA CACHETTE shall not be held responsible for the non-performance of the contract concluded in the event of force majeure, technical problems, disruption or total or partial strike. Likewise, HÔTEL LA CACHETTE cannot be held responsible if the poor execution of the stay is attributable to the CLIENT or to the unforeseeable and insurmountable act of a third party unrelated to the provision of the reserved services. HÔTEL LA CACHETTE shall not be held liable for any indirect damages, operating losses, loss of profit, loss of opportunity, damages or expenses.
3 – Minority :
It is reminded that in application of article 1124 of the Civil Code, non-emancipated minors are incapable of contracting. Consequently, reservations and sales intended for unaccompanied minors will not be accepted, it being specified that HÔTEL LA CACHETTE does not always have the capacity to identify minors.
4 – Internet:
The HÔTEL LA CACHETTE website, and sometimes the emails sent, may contain hypertext links that may lead to websites or pages other than the HÔTEL LA CACHETTE website. HÔTEL LA CACHETTE declines all responsibility in the event that the content of these websites and pages contravenes the legal and regulatory provisions in force, or that they contain content or images that may be offensive.
Furthermore, any creation of hypertext links to the home page of the HÔTEL LA CACHETTE website is subject to its express, prior and written consent.
HÔTEL LA CACHETTE shall not be held responsible for any direct or indirect damage resulting from the fraudulent intervention of a third party leading to a modification of the information made available on its website.
5 – Photographs:
The photographs present on the various HÔTEL LA CACHETTE media are illustrative. They are the property of the company.
III. INTELLECTUAL PROPERTY
In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, all elements, texts, images, photographs, trademarks, designs, models, logos, graphics, etc. present on the various media such as the www.hotellacachette.fr website, as well as on all other media on which HÔTEL LA CACHETTE is present (other websites, brochures, guides, leaflets, etc.), as well as their compilation, are the exclusive property of HÔTEL LA CACHETTE (or of the photographers & directors who have produced the views/films/photos). HÔTEL LA CACHETTE does not grant any license, nor any other right than the right to consult the various media made available.
The reproduction or use of all or part of these elements is only authorized for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes an infringement and is punishable under the Intellectual Property Act, except with prior written authorization from HÔTEL LA CACHETTE.
IV. APPLICABLE TEXTS & JURISDICTION
The present are subjected to the French law. The language of the present contract of sale is the French language.
In the event of a dispute and in accordance with article L.141-5 of the French Consumer Code, “the consumer may choose, in addition to one of the territorially competent jurisdictions under the Code of Civil Procedure, the jurisdiction of the place where he/she lived at the time of the conclusion of the contract or of the occurrence of the harmful event. In the event of a dispute of a commercial nature, only the Court of Romans (26, Drôme) is competent.
V. APPLICATION and MODIFICATION OF THE GENERAL TERMS OF SALE
1 – Waiver :
Any condition contrary to these General Terms and Conditions of Sale and set forth by the CUSTOMER will, in the absence of express acceptance by HÔTEL LA CACHETTE, be unenforceable regardless of when it may have been brought to its attention. The fact that L’HÔTEL LA CACHETTE does not take advantage of any of the present General Terms of Sale at a given time cannot be interpreted as a waiver of the right to take advantage of any of the aforementioned conditions at a later date.
In all cases, the present General Terms and Conditions of Sale prevail over any other conditions set by the partners of HÔTEL LA CACHETTE.
2 – Modification :
In view of possible developments, HÔTEL LA CACHETTE reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. The new General Terms and Conditions of Sale will be brought to the CUSTOMER’s attention by modifying the company’s website and the various media when they are reissued. They will be applicable only to sales made after the modification.
Any complaint must be addressed to HÔTEL LA CACHETTE by the means described in Title I – II above. The CUSTOMER and HÔTEL LA CACHETTE will give priority to finding an amicable solution.
